Right of withdrawal
Cases of exclusion of the right of withdrawal
Pursuant to art. 59, paragraph 1, lett. d) and e) of Legislative Decree no. 6 September 2005 206 (Consumer Code) and subsequent amendments (Legislative Decree 21/2014), the right of withdrawal is excluded in relation to
- a) goods purchased by a non-consumer and/or requiring an invoice
- (b) sealed goods which are unsuitable for return for reasons of hygiene or health protection and which have been opened after delivery.
Exercise of the right of withdrawal
The User may exercise the right to withdraw, pursuant to art. 52 and ff. of Legislative Decree 206/2005, in relation to specific Products other than those processed by LangheMyFood S.r.l. provided that these, after delivery, have not been opened or their seals altered.
In cases where the exercise of the right of withdrawal is permitted, the User has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without penalty.
In order to exercise the right of withdrawal, Users must send LangheMyFood S.r.l., within 14 days from the date of delivery of the Products, a written communication by e-mail to the following e-mail address email@example.com with the subject "Exercise of the right of withdrawal", expressly stating their wish to withdraw and providing the following additional information:
- purchase order number and date
- delivery date of the purchase order
- name and address of the consumer
- indication of an email and telephone number of the consumer
- code of the article(s) in respect of which the right of withdrawal is to be exercised
Upon receipt of the communication exercising the right of withdrawal, LangheMyFood S.r.l. will open a file for the management of the return.
The User must return to the Company, or to a third party authorized by the Company, without delay and in any case no later than 14 (fourteen) days from the date of communication of his withdrawal, all the Products purchased under the contract from which he withdrew, bearing the direct cost of returning the Products. In the case of direct return to the Company, the Products must be sent to the following address: LangheMyFood S.r.l. - Via Vivaro, 29/A - 12051 Alba (CN) Italy. The Products must be returned intact and, in any case, in the same state in which they were received by the User. The refund shall be made by the Company through the same means of payment selected and used by the Consumer with reference to the order for which he/she has exercised the right to withdraw.
Products that cannot be returned
Products may not be returned in the cases referred to in Article 59 of the Consumer Code, for example for the purchase of products specially customized, engraved or individualized, for the supply of sealed items not eligible for return for health or hygiene reasons which after delivery have been removed the seals, etc..
Sealed goods which are not suitable for return for hygienic or health protection reasons and which have been opened after delivery will not be returned.
